Terms and Conditions for Electrical Services

These Terms and Conditions ("Terms") govern the provision of electrical services ("Services") by Test Valley Electrical Services,("we", "us", or "our") to you, the customer ("you" or "your"). These Terms apply to all contracts for the supply of Services, whether to consumers or commercial clients, unless otherwise specified. By accepting a quotation or instructing us to proceed with the Services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree, do not proceed with the Services. These Terms incorporate any quotation provided and prevail over any other terms you may propose unless we agree in writing.

1. Definitions and Interpretation

1.1 In these Terms, unless the context otherwise requires, the following expressions have the following meanings:

- "Contract" means the agreement between you and us for the provision of Services, incorporating these Terms.

- "Customer" or "you" means the individual or business entering into the Contract with us. If you are entering on behalf of a business, you confirm you have authority to bind that business.

- "Estimate" means our written Estimate for the Services, valid for 30 days unless stated otherwise, detailing the scope of works, price, and any assumptions.

- "Services" means the electrical installation, maintenance, repair, testing, inspection, wiring, or other works described in the Estimate or agreed upon.

- "Site" means the premises where the Services are to be performed.

- "We", "us", or "our" means Test Valley Electrical Services, including our employees, agents, and subcontractors.

1.2 References to statutes are to those as amended or re-enacted. Headings are for convenience only. Singular includes plural, and masculine includes feminine and neuter.

1.3 "Consumer" means an individual acting for purposes outside their trade, business, or profession, as defined in the Consumer Rights Act 2015

2. Basis of the Contract

2.1 A Contract is formed when you accept our Estimate in writing, verbally, or by conduct (e.g., allowing us to start work), or when we accept your order.

2.2 The Contract includes these Terms, the Estimate, and any agreed variations. No other terms apply unless we agree in writing.

2.3 You are responsible for providing accurate information. Our Estimate is based on details provided at the time. If discrepancies arise (e.g., unforeseen issues), we may adjust the price or scope, notifying you promptly.

2.4 We reserve the right to refuse or decline work at our discretion.

2.5 All Services comply with BS 7671 (IET Wiring Regulations, current edition) and relevant UK standards.

2.6 Provisional Booking and Authorisation: If we provisionally book a date for the Services prior to submitting the Estimate, you will be notified of the provisional booking in writing. Failure to provide a formal response (e.g. acceptance or rejection of the Estimate) within 48 hours of receiving the Estimate will be deemed as your authorisation for us to proceed with the pre-booked work on the agreed date, subject to these Terms. You may cancel the provisional booking without charge up to 24 hours before the scheduled start date, provided no work has commenced.

2.7 Financial Capability and Payment Terms: Accepting the Estimate confirms you or your organisation can afford the quoted amount plus any agreed amendments. Payments are due immediately upon receipt of invoices.

3. The Services

3.1 We will perform the Services with reasonable care and skill, using qualified personnel, during normal working hours (e.g., 8:30 am to 5:00 pm, Monday to Friday) unless otherwise agreed.

3.2 Dates for completion are estimates only. We are not liable for delays unless caused by our negligence.

3.3 We may use subcontractors where appropriate, but remain responsible for the Services.

3.4 Any sketches, plans, or samples are illustrative and not binding unless specified in the Quotation.

3.5 We may make minor non-aesthetic changes to materials or specifications without notice if they do not affect quality or performance.

3.6 Condition of Existing Installation: Unless otherwise stated in the Estimate, we assume your existing electrical installation is free of pre-existing electrical faults, including but not limited to earth faults, ring open circuits, insufficient bonding, or defective Residual Current Devices (RCDs), and is compliant with the relevant BS 7671 (IET Wiring Regulations, of the time of original installation). If any such faults are identified that require rectification to ensure the agreed Services remain compliant with BS 7671, such remedial work falls outside the original scope and will be quoted separately and is chargeable. We will notify you promptly of any such issues and may suspend work until agreement is reached on the additional costs.

3.7 All work meets current electrical safety standards. We will issue certificates (e.g., Electrical Installation Certificate) upon completion and full payment.

3.8 Third-Party Damage, Theft, or Vandalism: For installation work in progress at your property, particularly on large projects, you or your appointed project manager are responsible for ensuring the security of the work area and our materials, tools, and equipment. We are not liable for any loss, damage, or delay to the Services caused by third-party actions, including but not limited to theft, vandalism, damage by other trades, or trade negligence (e.g., burst or loose water pipes). Any resulting loss of materials or remedial work required to rectify such damage falls outside the original scope of work and will be chargeable. We will notify you promptly of any such issues and provide an estimate for the additional costs.

3.9 Customer-Supplied Materials: We may accept customer-supplied materials or accessories if they meet BS 7671 standards. No warranty is provided for these. Remedial work for faulty customer-supplied accessories is chargeable at our standard rates. We will notify you of issues and provide a quotation.

3.10 White Goods and Fixed Wire Testing: We will make reasonable efforts to unplug and disconnect white goods before fixed wire testing to ensure safety and compliance with BS 7671. We are not liable for damage to appliances where safe disconnection is not practicable (e.g., hardwired or inaccessible plug tops). Any remedial work for such damage is chargeable. We will notify you of any issues before testing.

4. Your Obligations

4.1 You must provide safe, unobstructed access to the Site, including parking and facilities (e.g. power, water, toilet facilities).

4.2 Obtain all necessary consents (e.g., planning permission, building regulations, landlord approval) at your expense.

4.3 Inform us of any hazards, such as concealed wiring, pipes, asbestos, or structural issues. You are liable for damage if not disclosed.

4.4 Move furniture, carpets, or obstructions before we start. We may charge for delays or assistance.

4.5 Ensure the Site is safe and compliant with health and safety laws.

4.6 If you are a Consumer, you have additional rights under the Consumer Rights Act 2015.

5. Estimates and Variations

5.1 Estimates are based on a non-destructive survey and assume the existing installation is compliant. Additional work (e.g., remedial) will be estimated separately.

5.2 Variations to the scope must be agreed in writing. We will provide a revised Estimate, and extra costs/time will apply.

5.3 Pricing Based on Outcome: Unless otherwise specified in the Estimate, all prices are fixed for the agreed scope of work and are based on achieving the specified outcome, not on the time spent performing the Services. Any additional work or variations outside the original scope will be subject to a separate Estimate.

5.4 If unforeseen issues arise (e.g., hidden defects), we will notify you and may suspend work until agreed.

5.5 Amendments to Project Drawings: Any prompt amendments to site project drawings or specifications that result in additional work or materials beyond the original Estimate to fulfill the revised specification will be chargeable. We will notify you promptly of the impact of such amendments and provide a revised Estimate for the additional costs. Work may be suspended until agreement is reached on the additional costs.

5.6 Estimate Amendments: Estimates are free and include one amendment at no cost. Further amendments are chargeable at our standard rates, absorbed into the project if work is accepted, or invoiced separately if not. We will notify you of charges and provide an estimate.

6. Price and Payment

6.1 Prices are as estimated, We may adjust for variations, material cost increases, or errors.

6.2 For projects over £1,500 for domestic, £3,000 for commercial, a deposit 15% is required before starting.

6.3 Payment is due on completion or as staged (e.g., interim invoices). For time-and-materials work, we charge hourly rates plus materials.

6.4 Overdue payments may accrue interest at 8% above the Bank of England base rate. We may suspend Services or withhold certificates until paid.

6.5 Title to materials passes on full payment. Risk passes on delivery.

7. Guarantees and Warranties

7.1 We guarantee our workmanship for 12 months from completion. Defects due to our fault will be remedied free of charge if notified in writing within the period.

7.2 Materials are covered by manufacturer warranties. We pass these on but do not guarantee beyond that.

7.3 Guarantees exclude fair wear and tear, misuse, or third-party interference.

7.4 Unrelated Electrical Faults: Faults reported within the 12-month guarantee period, if unrelated to our work (e.g., pre-existing or separate circuits), will incur chargeable investigation or remedial work at our standard rates. We will notify you of findings and provide a quotation.

8. Liability and Insurance

8.1 We are not liable for indirect or consequential losses (e.g., loss of profits, data).

8.2 Our liability is limited to the Contract value, except for death/personal injury caused by negligence or fraud.

8.3 We carry public liability insurance up to £2,000,000. You should insure your property and contents.

8.4 We are not liable for damage to decorations, flooring, or pre-existing defects unless caused by our negligence.

9. Termination and Cancellation

9.1 Consumers may cancel within 14 days of Contract formation (cooling-off period) without charge, unless Services have started with your consent.

9.2 Either party may terminate for material breach, giving notice. We may terminate if you fail to pay or provide access.

9.3 On termination, you pay for work done to date. Deposits are non-refundable if cancellation is less than 24 hours before start, unless we are deemed at fault.

10. Data Protection

10.1 We process personal data in accordance with the UK GDPR and Data Protection Act 2018. We collect data for Contract performance, such as contact details.

10.2 We may share data with subcontractors or regulators as needed. You have rights to access, rectify, or erase data. See our Privacy Policy for details.

11. Force Majeure

11.1 Neither party is liable for delays or failures due to events beyond reasonable control (e.g., strikes, weather, supply shortages). We will notify you and resume as soon as possible.

12. Complaints and Dispute Resolution

12.1 If dissatisfied, contact us in writing within 28 days of completion. We aim to resolve amicably.

12.2 If unresolved, Consumers may use alternative dispute resolution (e.g., via Napit or ombudsman). Commercial disputes may go to court.

12.3 Online Reviews and Defamation: You agree to provide fair and accurate feedback in any online reviews or public statements about our Services. You shall not post false, misleading, or defamatory content that harms our reputation. We reserve the right to take legal action against any defamatory or malicious statements, including but not limited to slander, libel, or harmful falsehood, and to seek remedies for any resulting loss or damage.

12.4 We are members of Napit, registration: 76586.

13. General

13.1 We may assign or subcontract the Contract. You may not without our consent.

13.2 Notices must be in writing. Waiver of a breach does not waive future breaches.

13.3 If any provision is invalid, the rest remain enforceable.

13.4 These Terms are governed by English law. Disputes are subject to the exclusive jurisdiction of English courts.

13.5 We do not dispose of waste unless agreed (extra charge). You handle redecoration.
